Paper for Water (“Paper for Water,” “we,” “us,” or “our”) welcomes you to our platform. We invite you to access and use our online Platform (“website,” “services,” “site”), which are available to you (“user,” “visitor,” “donor,” “representative,” “registered users”) through portals, sites, mobile browser, and platform including https://www.paperforwater.org.

We provide our Platform and its designated Services to our Visitors and Registered Users subject to the following Terms of Use, which may be updated by us periodically without prior notice to you. The following Terms of Use are a binding agreement between the user and the Paper for Water’s Platform. Your initial access and continuous usage of all areas within the Website that require registration, included but not limited to: your reading of content, understanding and acceptance of our Terms of Use, Privacy Policy and Donor Privacy Policy (if it applies), which is hereby incorporated by reference, known as “Agreement”). If you happen to disagree with any clauses included in this Agreement, please immediately stop using the Services.

1. Description and Usage of Services


Paper for Water helps decrease the impact of the water crisis and various communities around the world by bringing awareness, providing a platform to help people execute a donation (“donors”), providing a platform for social volunteer work opportunities (“volunteers,” “youth representatives,” “representatives”), and providing opportunities for corporate partnerships (“sponsors,” “corporate partnerships”).

We provide Visitors, Registered Users, Representatives and Volunteers with access to Platform services as described in this Agreement.

Visitors. Visitors, as the term implies, are people visiting our platform with no registration within our platform, who have access to various pages of our website. No login is required for our visitors. Our visitors can: read our content, view any publicly-available content, subscribe to our newsletter and contact us. Visitors without a login to our platform will be unable to execute donations due to security measures.

Registered Users. To be considered a Registered Users, a login is required. They will have access to all functions by the visitors and additionally can make donations, sign up for recurring donations, and update their account information.

Representatives. Login is required and acceptance by Paper for Water to become a Representative is required. Representatives are responsible for representing Paper for Water in their designated areas, raise awareness, and organize volunteer opportunities. They will have exclusive access to the amount of donations raised by their own links.

Volunteers. To apply for volunteer opportunities, the volunteer will have to provide to us Personal Information and contact us. As an initial access, you do not need to be a Registered Users.

2. Community Rules


Paper for Water’s community functions its most effective when its users abide to simple rules. By accessing and using our Platform, you agree to comply with Community Rules, including any Third-Party Applications through the Platform, and that:

- You will not use the Platform for any unlawful purpose;
- You will not upload, post, email, transmit, or make available any content that: infringes any copyright, trademark, right of publicity, or any other proprietary rights of any person or entity; you do not have the right to make available under any law or under any contractual or fiduciary relationship (such as confidential and proprietary information learned or disclosed as part of employment relationships or under nondisclosure agreements); defamatory, libelous, knowingly false, obscene, explicits or invasive of another’s privacy, promotes violence or includes hate speech. (speech that attacks or demeans a group based on race or ethnic origin, religion, disability, gender, age, veteran status, and/or gender identity); or discloses any sensitive information about another person, including that person’s email address, mailing or permanent address, phone number, credit card information, or any similar information;
- You will not “stalk”, threaten, or otherwise harass another User, Registered User, Volunteer or Representatives;
- You will not instigate or encourage other to commit or encourage other activities not abiding to the law or cause any injury or property damage to any given person;
- You will treat everyone with respect in the community to all its members;
- You will not spam or use the system to raise money for personal reasons;
- You will not use our system to collect any type of market research for a competing business or businesses;
- You will not try to acquire any information or resources intentionally other than the public content available;
- You will not post any irrelevant topic or material to the website;
- You will not violate any local, state, national, or international law applicable;
- You will not impersonate any personal or entity or falsely state or misrepresent your affiliation with a person or entity;
- You will not cover, obscure, block, or in any way, interfere with any promoted messages and/or safety features on the Platform; and
- You will let Paper for Water know about inappropriate content or any breaking of this community rules by contacting [email protected].

3. Restrictions


The Platform is available for individuals aged 18 years or older. If you are 13 or older, but under the age of 18, you should review the Agreement with your guardian or parents to make sure both parties understand it and agree with it.

4. Sign-In Name; Password; Unique Identifiers


During the registration process of Registered Users, you will be asked to create an account, which includes a sign-in name (username), password, and designated additional information that will assist in authenticating your identity when you login in the future. When you create an account within our Platform, you must provide the latest, accurate, and complete information. Each username and password can only be used by one Registered User. You are fully responsible over your login information including but not limited to: username, password, and any other personal information, as well as for any use, misuse, or communications entered through the Platforms using one or more of them. If you need to deactivate a password or username information, you need to inform us prior to [email protected]. We reserve the right to delete or change your password, username, or any other information or any time and for any other reason. Paper for Water will not be liable for any loss or damage caused by any unauthorized use of your account.

5. Intellectual Property


Our Platform contains content such as: software, text, graphics, images, sound recordings, audiovisual works, and any other material offered by Paper for Water (referred to as “Content”). The Content may be owned by us or by any third parties. Content is protected under both, the United State or any foreign laws. Unauthorized use of Content may violate copyright, trademark, and other laws. You have no rights in or to Content, and you will not use the Content, except as permitted under the following Agreement or given access by us through a written content. You must retain all copyright and other proprietary notices contained in the original Content. You may not sell, transfer, assign, license, sublicense, or modify Content or reproduce, display, publicly perform, or otherwise use Content in any way for any public or commercial purpose. The use or posting of Content on any other website, other than through Third-Party Applications, or in a networked computer environment for any purpose is expressly prohibited.

If any violate any portion of the Agreement, the permission to access and/or use Content and the Platform automatically is terminated and all copies made by you of our Content should be automatically and immediately deleted.

The trademarks, service marks, and logos of Paper for Water used and displayed on the Platform are registered and unregistered trademarks or service marks of Paper for Water. Other company, product, and service names located on the Platform may be trademarks or services marks owned by other.

6. Communications With Us


Communications From Paper for Water. You understand and agree that, part of your Registration Process within our platform, Paper for Water may send to you certain communications such as donation confirmation, shipment confirmation, service announcement, volunteer opportunities, announcement of new products, water well projects, or any other updates we deem necessary for our relationship building with our Registered Users.

Communications to Paper for Water. We encourage you to contact us, but we please ask that you do not share any contain containing confidential information. Please don’t send us any information that you do not have a right to make available under any law. With respect to all communications you send to us, including, but not limited to, feedback, questions, comments, suggestions, and the like, we shall be free to use any ideas, concepts, know-how, or techniques contained in your communications for any purpose whatsoever, including but not limited to, the development, production, and marketing of products and services that incorporate such information without any payment or obligation to you.

7. No Warranties; Limitations of Liability


WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT ANY CONTENT OF THE SERVICE SUCH AS ANY REVIEWS, RATINGS, FINANCIAL DATA, OR USER CONTENT. WE SHALL NOT BE SUBJECT TO LIABILITY FOR ANY DELAYS OR INTERRUPTIONS OF THE SERVICES FROM WHATEVER CAUSE. YOU AGREE THAT YOU USE CONTENT, SERVICES, AND USER CONTENT AT YOUR OWN RISK.

WE DO NOT WARRANT THAT OUR PLATFORM WILL OPERATE ERROR-FREE OR THAT THE SERVICES, ITS SERVERS, CONTENT OR USER CONTENT ARE FREE OF DESTRUCTIVE FEATURES. IF YOUR USE OF CONTENT, USER CONTENT, OR THE SERVICES RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, WE SHALL NOT BE RESPONSIBLE FOR THOSE COSTS.

THE CONTENT, THE USER CONTENT, AND THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE WARRANTY OF TITLE, MERCHANTABILITY, NON-INFRINGEMENT OR THIRD PARTIES RIGHTS, AND FITNESS FOR PARTICULAR PURPOSE.

IN NO EVENT SHALL PAPER FOR WATER BE LIABLE FOR ANY DAMAGES INCLUDING, BUT NOT LIMITED TO: CONSEQUENTIAL AND/OR INCIDENTAL DAMAGES, LOSS OF PROFITS, OR DAMAGES RESULTING FROM DATA LOSS OR ANY KIND OF BUSINESS INTERRUPTION) AS A RESULT FROM USAGE, INABILITY OF USAGE, DISCLOSURE, DISPLAY OR MAINTENANCE OF ANY CONTENT, USER CONTENT, OR THE PLATFORM.

THE PLATFORM MAY CONTAIN TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS OR OMISSIONS. WE CONTAIN THE RIGHT TO MAKE CHANGES, CORRECTIONS, AND/OR IMPROVEMENTS TO THE SERVICES AT ANY TIME WITHOUT NOTICE.

8. External Sites


The Platform may contain links to third-party websites (“External Sites”). These links are provided solely as a convenience to you and not as an endorsement by us of the content of such External Sites. The content of on such sites were not developed by us and therefore you should contact the designated site administrator for those External Sites if you have any concerns regarding such links or any content located on such sites. We are not responsible for any content or accuracy of the material found on such outside sites along. We do not represent any of the content found on that site.

9. Compliance With Applicable Laws


The Platform is based on the United States. We make no claims in regards to Content or User Content that may be downloaded, viewed, or be appropriate for use outside of the United States. If you access the Platform and any of its content from outside of the United States, you are responsible for it. Either you are outside or inside the United States, you are completely responsible for ensuring compliance with the laws applied to your specific location.

10. Termination of the Agreement


We have the right to restrict, suspend, or terminate the Agreement and your access to all or any part of the Platform, at any given time and reason without giving any prior notice or liability. We have the right to change, suspend, or discontinue all or any specific part of the Platform at any given time and reason without giving any prior notice or liability.

11. Copyright Complaints

12. Miscellaneous


In the event that any portion of the Agreement is held to be invalid or unenforceable, the invalid or unenforceable portion shall be construed in accordance with the applicable law as nearly as possible to reflect the original intentions of the parties, and the remainder of the Agreement shall remain in full force and effect. The paragraph headings herein are provided only for reference and shall have no effect on the construction or interpretation of the Agreement. The Council of Nonprofits' failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of its right to subsequently enforce such provision or any other provision of this Agreement. Neither the course of conduct between parties nor trade practice shall act to modify any provision of the Agreement. The Agreement shall be governed by and construed in accordance with the laws of the State of Texas, except with regard to its conflicts of law rules. Any action relating to the Content, Site or this Agreement must be brought in the federal or state courts located in Texas and you hereby irrevocably consent to the jurisdiction of such courts. Any cause of action you may have with respect to the Content, Site or this Agreement must be commenced within one (1) year after the claim or cause of action arose, or be barred. This Agreement contains the entire agreement of the parties for this Site and supersedes all existing agreements and all other oral, written or other communication between the parties concerning its subject matter. You agree to use the Content and Site only for lawful purposes. You are prohibited from any use of the Content or Site that would constitute an illegal offense, give rise to liability or otherwise violate any applicable local, state, national or international law or regulation.
